By accessing and using the KPRIMEPAY platform, you accept the terms and conditions of this contract.

The General Conditions of Use (hereinafter called CGU or Contract) are intended to define the terms of use of KPRIMEPAY services. The user of KPRIMEPAY services expressly undertakes to comply with these General Conditions of Use of said services, as well as any subsequent modifications which may result from the use of the services. Accordingly, we recommend that you carefully read the terms of this KPRIMEPAY Services Agreement before accepting them. It is your responsibility to understand and comply with all laws, rules and regulations that may apply to you in connection with your use of KPRIMEPAY.
PRESENTATION OF KPRIMEPAY
KPRIMEPAY is a service provider enabling businesses to process credit card payments and mobile transactions, without having to open a merchant account with a bank or network (payment aggregator). KPRIMEPAY, as a Payment Services Provider (PSP), acts as an intermediary between businesses or financial institutions and their customers to facilitate payments for goods or services. The KPRIMEPAY platform is a transactional solution dedicated to businesses and financial institutions, both African and international. By collaborating with mobile operators, money transfer services and banks, KPRIMEPAY enables both domestic and international payments. Transactions can be made from mobile money accounts, money transfer services and bank cards to bank accounts or mobile money accounts. KPRIMEPAY offers businesses and financial institutions a range of digital solutions for selling, receiving and issuing payments, as well as optimized management of financial transactions. Each KPRIMEPAY account must be associated with a mobile telephone number validated by a telephone operator and an email address. It can also be linked to one or more bank accounts.
Contract conditions
By accessing the Service, you confirm that you have read, understood and accepted the T&Cs. We reserve the right to modify these conditions at any time. Changes will be posted on our website and will be effective upon posting. It is your responsibility to regularly consult the T&Cs to be informed of possible modifications.
Description of the Service
The Service allows users to manage their online payments via a single platform. Features include, but are not limited to:
- The aggregation of different payment methods.
- Carrying out secure financial transactions.
- Management of payment statements and transaction histories.
Registration and Account
To use the features of the KPRIMEPAY Service, you must create a user account. When registering, you must provide accurate, complete and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and must notify us immediately of any unauthorized use of your account.
Intellectual Property
You are authorized to use our service only for its intended purposes and in accordance with the terms of this policy. Any use of our intellectual property beyond what is expressly permitted by these terms requires our prior written permission.
Personal Data
We respect your privacy and process your personal data in accordance with our Privacy Policy. By using the KPRIMEPAY service, you agree to our collection and processing of your personal data under the terms of this policy.
Notifications for you
You agree that KPRIMEPAY may send you a notice or other information by posting it in your account, or by sending it to the email address or postal address indicated in your account, or by calling you on the telephone or by sending a text message. Except for notices regarding changes to this agreement, we will consider that you have received any notice sent within 24 hours after it is posted in your account or sent by email or SMS. You also have the opportunity to unsubscribe from receiving this information electronically by contacting KPRIMEPAY. In this case, KPRIMEPAY reserves the right to delete your account if you choose not to receive this information electronically. This regulates the collection, processing, transmission, storage, use and protection of personal data in Togo.

Any notice sent under this contract must be sent by email to the address [........................], by SMS, or by post to the address [........................].
Transactions and Fees
Certain features of the KPRIMEPAY Service may be subject to fees. Fees will be clearly stated before a transaction is finalized. You agree to pay all fees and charges associated with use of the Service. We reserve the right to change fees. Changes will be posted on our website and will be effective immediately upon posting. It is your responsibility to regularly consult the T&Cs to be informed of any possible modifications.
Security and Privacy
We implement appropriate security measures to protect your personal and financial information. However, we cannot guarantee the absence of security vulnerabilities. You should also take precautions to secure your personal information. The collection and processing of your data is governed by our Privacy Policy.
Prohibited Activities
- Fraud and Illegal Activities:
- Transactions related to illegal products or services (drugs, weapons, counterfeits, etc.).
- Scam, identity theft or any other form of fraud.
- Transactions with Unauthorized Parties:
- Using the Services to make payments to unauthorized or unverified individuals or entities.
- Money Laundering Activities:
- Fund transfers aimed at concealing the illegal origin of funds.
- Using the platform to structure transactions to avoid security alerts.
- Unregulated Gaming Activities:
- Providing incorrect or misleading information during registration or transactions.
- Providing falsified documents during registration and identity verification.
Limitation of Liability
In no event will we be liable for any indirect, special or consequential loss or damage arising out of the use of the service, including, without limitation, lost profits, business interruption, or damage to your computer systems. Our liability is limited to the amount of fees paid for the services provided.
ACCESSIBILITY AND CLASSIFICATION OF ACCOUNTS
Eligibility
To be eligible for our services:
- For a Business account:
- You must not have a criminal record in your state or the state where we operate.
- Have the documents required for your establishment in your country of activity.
- Have a valid mobile phone number as well as a valid email address.
- For a Personal account :
- You must not have a criminal record in your state or the state where we operate,
- Use the means of payment (mobile money account in your State or bank card),
- Have the necessary funds to make your payment.
Classification of accounts
KPRIMEPAY offers 2 types of accounts: a Business account and a Personal account.
Business Account
By opening a Business account and agreeing to the terms and conditions described in this agreement, you acknowledge that you are not creating the account for personal or family purposes.
Personal Account
By opening a personal account and agreeing to the terms and conditions described in this agreement, you acknowledge that you are creating this account for personal, non-commercial purposes. You agree to use the Account exclusively for transactions related to your personal and family needs, and not to manage commercial transactions, sales or other income-generating activities.
PAYMENTS
Provision of Payment Means
KPRIMEPAY is committed to providing users with payment methods integrated into its platform.
Validated Payment
When you receive a payment, you are instantly notified on your dashboard by email (except for API transactions). The amount paid, after deducting the KPRIMEPAY service fee, is automatically added to your account balance.
Payment Rejected
A payment is rejected if any step of the procedure is not validated, namely: (incorrect information, wrong secret code, no confirmation on your phone/other device, etc.), then the transaction is automatically interrupted and canceled. Your balance remains unchanged.
Processing Time for Financial Transactions and Withdrawals
Payments are processed and confirmed automatically in real time. However, the time it takes to top up your account or receive payments can vary from a few minutes to an hour depending on network availability, which is beyond technical capabilities. If a payment or withdrawal cannot be made, KPRIMEPAY will inform you immediately or upon request of the reason for the refusal.
Repayment of Funds
The transfer of money from your KPRIMEPAY account to your bank account, mobile money, or in cash via a partner network is subject to the processing times of each payment method. Generally, the transfer for mobile money or cash is made within twenty-four hours of the request, while for a bank account in the UEMOA zone, it can take up to seventy-two hours.
Payment in Multiple or International Currencies
For the moment, KPRIMEPAY only accepts XOF (CFA Franc of the West African Economic and Monetary Union, UEMOA). Any request to withdraw money from your account to a bank account, mobile money or in cash via a partner network must be converted into XOF before being sent to KPRIMEPAY. We do not process transactions in foreign currencies or currencies.
FEES
A fee is applied on each transaction with the recipient of the funds, while the payer only pays the net amount payable or, before each transaction, the payer is asked to add the fee so that the net amount payable is paid directly to the beneficiary. For more information, please consult the price list available on our site. Additional charges may apply in the following situations:
- To cover the costs of processing funds transfers (inter-state or non-UEMOA).
- For currency conversion, if applicable.
TERMINATION
We reserve the right to suspend or terminate your access to the Service in the event of a violation of the T&Cs, fraudulent behavior or for any other reason deemed necessary. You can also terminate your account at any time by contacting us via the platform's technical support.
APPLICABLE LAW AND JURISDICTION
The T&Cs are governed by Togolese law. Any dispute relating to the use of the service will be subject to the exclusive jurisdiction of the courts of the country.

ACCEPTANCE OF CONDITIONS
By subscribing to KPRIMEPAY services, you confirm that you have read, understood and accepted the conditions set out in this Contract.
